Decision to open lots to stop land transactions

Delegated Management and Government Assurance Committee under National Assembly has directed the government to move ahead with the work as per Land Use Act by making regulations as soon as possible.

A meeting of the committee held at Singha Durbar on Tuesday directed Ministry of Land Management, Cooperatives and Poverty Alleviation to proceed with the work as per Land Use Act by making rules stating that the ministerial decision to subdivide agricultural land was not in accordance with the law.

The committee is of the view that the ministerial decision to subdivide the agricultural land in the absence of necessary regulations for the implementation of Land Use Act is illegal and meaningless. Minister for Land Management, Cooperatives and Poverty Alleviation Padmakumari Aryal had rejected ministry's decision to stop allotment of agricultural land on August 3.

Committee Chairman Ram Narayan Bidari said that the ministry has been instructed not to implement the ambiguous issues in Land Use Act through circulars.

During the discussion, Minister for Land Management, Cooperatives and Poverty Alleviation Padma Aryal said that they have already decided to divide land based on the law until the regulations are made.

Minister Aryal claimed that the decision was taken in a hurry as there was a lot of distortion in the name of land subdivision. Minister Aryal said that the decision of ministry was nothing but the intention to maintain good governance.

In the meeting, lawmakers had said that running the directive on the basis of administrative order without making rules was against the principle of delegated legislation.

Lawmakers had said that the allotment of land without formulating regulations for a long time after the enactment of Land Use Act has raised doubts.

A writ petition filed in the Supreme Court against the ministerial decision to subdivide agricultural land is currently pending.
