Dissolvement of House of Representatives is unconstitutional: Law practitioners

Lawmakers have argued that President Vidyadevi Bhandari's dissolvent of the House of Representatives, as recommended by Prime Minister KP Sharma Oli, is unconstitutional and should be overturned by the Supreme Court.

He also said that the court could restore the disbanded House of Representatives.

Speaking in an interview with Reporters Club Nepal on Sunday, senior advocate Sher Bahadur KC, who is also the former president of the Nepal Bar Association, said that the dissolution of the parliament was the end of the 2072 BS constitution.

He said that even though the constitution did not give the right to dissolve the parliament to Prime Minister KP Sharma Oli, it led the country towards autocracy.

Similarly, Prem Bahadur Khadka, former president of the Nepal Bar Association, argued that the constitution cannot be dissolved without five years of date given.

Senior Advocate General Raman Shrestha, who is also a former Attorney General, said that the move to dissolve the House of Representatives of Prime Minister KP Sharma Oli was unconstitutional. He said that the dissolved parliament could be restored.

Senior Advocate Borna Bahadur Karki argued that Prime Minister KP Sharma Oli had taken a treacherous step against the constitution. He said that steps have been taken to trap Nepal's politics in a hazardous situation with political instability.  

Senior Advocate Dr. Dinesh Tripathi said that Prime Minister KP Sharma Oli had murdererd democracy by recommending the dissolution of the parliament and accused President Bhandari of being a traitor.
